Stolen Vehicle Abandoned in Canastota, Driver Dies in Crash following Pursuit

(Albany, NY - February 6, 2012) The Canastota Police Department advised the State Police on the Thruway to be on the lookout for a stolen Hyundai Elantra.

Fultonville Troopers located the vehicle eastbound by the Fultonville exit. An attempt to stop the vehicle resulted in a high speed pursuit.  The operator attempted to exit the Thruway at Exit 23 in Albany.  He was traveling too fast and the vehicle skidded off the ramp and into trees.  The operator was deceased on impact.

Further investigation determined Ricardo Bernabeu Jr, 25, from Northview Terrace,  Rochester, was driving a Lexus stolen in Rochester that he abandoned at the Savon Gas Station at North Peterboro Street in Canastota where he stole the Hyundai from in front of the store.

 

Utica Woman Arrested for DWI

(Oneida, NY – Jan. Feb. 2012) Charlene M Sullivan, 29, of Hawthorne Avenue, Utica was arrested Jan. 27 on charges of; Driving while Intoxicated, Failure to keep right and Refused Pre-Screening test. Sullivan was charged after she allegedly struck a vehicle head on Jan. 17 at about 9:18 p.m. at Genesee Street and Upper Lenox Avenue. Sullivan was traveling west on Genesee Street when she turned right off of Genesee Street onto Upper Lenox Avenue to travel east when she went into the wrong lane and struck a west bound vehicle on Upper Lenox Ave. Sullivan was arraigned and committed to Madison County Jail in lieu of bail set at $1,000 to appear Feb. 3.

Rodney C. Ortman, 43, of N. Main Street, Oneida was charged on Jan. 31 with second-degree Aggravated Unlicensed Operation and Speed in Zone. He is to appear Feb. 17.

Christine D. Denney, 35, of Lenox Avenue, Oneida was issued a criminal summons Jan. 31 to appear in Oneida City Court Feb. 7 to answer a charge of second-degree Harassment. She is alleged to have physically harassed another person.

William W. Sochia, 21, of Pond Hill Road, Taberg was charged Feb. 1 with second-degree Harassment. He is to appear Feb. 3. He is alleged to have physically harassed another person.

Brian A. Hubbard, 21, of Vienna Road, Sylvan Beach was issued an appearance ticket Feb. 1 to appear in Oneida City Court Feb. 17 to answer a charge of Unlawful Possession of marijuana.

Deanna S. Warner, 36, of Seneca Turnpike, Canastota was charged Feb. 2 with Petit Larceny, seventh- degree Criminal Possession of a Controlled Substance and Unlawful possession of marijuana. Warner is alleged to have stolen property from another person and to have possessed marijuana and a schedule V controlled substance. She is to appear in court Feb. 10.

A 17-year-old resident of Cherrywood Lane, Rome was arrested Feb. 2 on a charge of second-degree Criminal Contempt. He is alleged to have violated a court order. He was arraigned and committed to Madison County Jail in lieu of bail to appear Feb. 3.

 

 

 

 

 

 

 

 

 

 

 

 

 

 

 

 

Canastota Man involved in three-car accident in Vernon

(Vernon, NY – Feb. 3, 2012) State Police in Oneida investigated a three car personal injury accident on State Route 5 between Hawthorne Drive and Youngs Road in the Town of Vernon, which occurred at approximately 3:42 p.m. Feb. 1.

Beatrice H. Jones, 79, of Route 5, Vernon was driving her 2008 Chevrolet eastbound on State Route 5 followed by a 2005 Toyota Prius operated by Alex P. Dudajek, 87, of Clinton Street, New York Mills when Jones stopped to allow oncoming traffic to pass before making a left turn into her driveway.

Dudajek failed to observe the Jones vehicle stopped in the eastbound lane and struck the Jones vehicle in the rear.  The force of the impact caused the Jones vehicle to enter the westbound lane of Route 5 and into the path of a westbound 2008 Ford van operated by Joseph F. Verro, 60, of Center Street, Canastota.  The Verro vehicle struck the Jones vehicle and travelled off the north side of the roadway, where it overturned onto its roof in a ditch.

Beatrice Jones was trapped inside of her vehicle and had to be extricated by members of the Vernon Fire Department using hydraulic tools.

Jones was transported by Vineall Ambulance to St. Elizabeth’s Trauma Center in Utica, where she was treated for broken bones and internal injuries.

Dudajek complained of chest pain at the scene and was transported by private vehicle to Faxton Hospital in Utica for treatment.

A passenger in the Verro vehicle, David P. Hart, 55, was treated at the scene for lacerations to his hand and transported by private vehicle to Oneida Healthcare for further evaluation.

Alex Dudajek was issued a traffic ticket for speed not reasonable and prudent returnable in the Town of Vernon Court on Feb. 15, 2012.

 

Canastota Man Dead after Truck Strikes Culvert

(Town of Sullivan, NY – Feb. 2, 2012) Sullivan-based state police are investigating a one car fatal motor vehicle accident, which occurred on Lakeport Road in the Town of Sullivan at approximately 2:05 p.m. Feb. 2.

A 2000 Chevrolet pickup truck operated by Charles G. Stevens, 82, of Route 5, Canastota was southbound on Lakeport Road, south of Smith Ridge Road, when the truck travelled off the east side of the roadway, struck a culvert and some small trees and overturned into a stream.

Stevens was removed from the vehicle by fire personnel from the North Chittenango Fire Department and transported by Rural Metro Ambulance to SUNY Upstate Medical Center in Syracuse, where he was pronounced deceased.

Madison County Sheriff’s Deputies Investigating Hit and Run Accident

(Georgetown, NY – Feb. 1, 2012) Madison County Sheriff’s deputies are investigating a hit and run accident that occurred at 7:25 p.m. Feb. 1 on State Route 26 between East Hill Road and Bronder Hollow Road in Georgetown.

A 76-year-old male was walking along State Route 26 when he was struck from behind by a passing vehicle. The only description is that the vehicle is a smaller car, dark in color. No make, model or other identifying information is available. The vehicle is missing the passenger side mirror as a result of this accident.

The victim was transported to Upstate Hospital in Syracuse by Georgetown Ambulance with injuries that are described as non-life threatening. His identity is not being released at this time to ensure family members are notified.

Chittenango Police Seek Public’s Assistance

(Chittenango, NY- Feb. 1, 2012) The Chittenango Police Dept is asking assistance from the public in helping identify the white male in this photo.

The subject used a credit card stolen from a residence in the Village of Chittenango on Jan. 7. The subject used the card to make a purchase inside the Nice N Easy Store on Route 5 in the town of Lenox at about 11:19 a.m. on Jan. 9.

The subject did get into the passenger side of late model gray colored pickup.

New York State Police announce Super Bowl weekend drunk driving initiative

(Oneida, NY – Jan. 30, 2012) The New York State Police in Troop D announced a three-day campaign to crack down on drunk drivers this upcoming Super Bowl weekend.  The campaign will begin Friday, Feb. 3 and continue through Sunday, Feb. 5. The Super Bowl featuring the New England Patriots and New York Giants will be played on Sunday.

If football fans plan on drinking during the Super Bowl, designating a sober driver can help increase the chance of avoiding an alcohol-impaired-driving crash. Alcohol-impaired driving is no accident nor is it a victimless crime. 10,228 people died nationwide in motor vehicle crashes in 2010 in which an impaired driver had a blood alcohol concentration of .08 percent or higher.

There are just too many drivers out there who believe that having just a few drinks and getting behind the wheel of a vehicle is harmless. But numbers don’t lie. Drinking and driving can result in loss of life or serious injury. These not only affect the lives of the impaired driver but can affect other families as well.

When you choose to drink, drink responsibly, and pass your keys to a sober driver. Driving impaired or riding with someone who is impaired is not worth the risk. If you know of someone who has been drinking and is planning to drive, please remember Fans Don’t Let Fans Drive Drunk.

 

Lost Hikers Rescued from Park

(Town of Fenner, NY – Jan. 2012) A few tense moments ended in skilled rescue at Chittenango Falls State Park on State Route 13 Jan. 28. Sheriff’s deputies and state park police received a call reporting two hikers lost in the park just before 6 p.m.

Upon arrival, Deputies communicated with the Madison County 911 Center to get a better location of the hikers, as 911 Center personnel were in contact with one of the hikers via cell phone. Deputies drove their vehicles in the area with their emergency lights on until the hikers could see the flashes of the emergency lights, and made their way to the side of a sharp, steep hill that parallels Chittenango Creek, just north of the main park entrance.

Deputies established communication with the pair and provided instructions so they would remain safe. Chittenango, along with North Chittenango, Cazenovia and Lincoln Fire Departments responded when the call for a rope rescue was issued.

An aerial ladder truck from Chittenango Fire Department was deployed; rescuers extended the ladder over the very fast flowing creek. Rope rescue personnel crossed the creek and climbed up the hill on the other side, guiding the hikers across the ladder and to a waiting ambulance.

The hikers, Brian Abramowitz of Commack and Jenna Goldberg of Jericho, both 22, were evaluated on the scene by Cazenovia Area Volunteer Ambulance Corp due to their prolonged exposure. They were not transported to a hospital as both refused further medical treatment.

The hikers had been trying to find their way out of the park for nearly three hours when they called 911 for help.

Anthony J. Graham, 32, of Stone Street, Oneida was arrested Jan. 20 on charges of; first-degree Falsifying Business Records, a class E Felony, Obtain Controlled Substance through fraud/deceit and seventh-degree Criminal Possession of a Controlled Substance. Graham is alleged to have fraudulently obtained a prescription for a schedule III Controlled Substance and passed the prescription. He is to appear in court Feb. 3.

A 17-year-old resident of Cherrywood Lane, Rome was charged Jan. 21 with second-degree Criminal Contempt. He is alleged to have violated a court order. He is to appear in court Feb. 3.

Ashlee M. Sanchez, 18, of Madison Street, Oneida was charged Jan. 21 with fifth-degree Criminal Solicitation. She is alleged to have allowed and assisted another in violating a court order. She is to appear in court Feb. 10.

John A. Farnham, 29, of Madison Street, Oneida was charged Jan. 22 with Disorderly Conduct and Obstructing Emergency Medical Services. Farnham is alleged to have at about 10:44 p.m. obstructed the Oneida City Fire Department Rescue Squad from responding to an emergency medical call by stepping in front of the rescue truck on Oneida Street causing the vehicle to stop and refused to move from in front of the truck.  He was to appear in court Jan. 27.

Joe N. McRae, 29, Barlow Street, Canastota was arrested Jan. 23 on a charge of second-degree Aggravated Unlicensed Operation. He was arraigned and committed to Madison County Jail in lieu of bail set at $500 cash or $1,000 bond to appear Jan. 27.

John C. Carrier, 45, of Schoolheimer Road, Oneida was arrested Jan. 26 on charges of; Driving while Intoxicated, Operating with a BAC of .08 of one percent or more of alcohol and Failure to keep right. He is to appear in court Feb. 10.

Joe N. McRae, 29, of Barlow Street, Canastota was arrested Jan. 26 on charges of second-degree Aggravated Unlicensed Operation, failure to stop at a stop sign and Speed in zone. He was arraigned and committed to Madison County Jail in lieu of bail set at $2,500 to appear Jan. 27.

Matthew J. Clute, 24, of Valenti Estates, Oneida was arrested Jan. 27 on charges of; Driving while Intoxicated, Aggravated Driving while Intoxicated, Improper right turn and Failure to keep right. He is to appear in court Feb. 3.

 

 

 

 

 

 

 

Significant Portions of Oneida Nation Backed Claim Dismissed on Preliminary Motions

(Madison County, NY – Jan. 27, 2012) On Jan. 24, 2012, the Albany County Supreme Court issued a decision granting in part a motion to dismiss an Oneida Nation (OIN)-funded lawsuit filed against Comptroller DiNapoli and Madison County Attorney John Campanie. The lawsuit takes issue with legal fees paid to the Oneida and Madison County attorneys’ private law offices for work done in support of the repeatedly successful land claim litigation defense against the OIN.

The complaint, brought as a “taxpayer action” by two OIN employees, could not have been initiated by the OIN in its own right because it is neither a citizen nor a taxpaying entity. The Court determined that the Comptroller, who refused a demand by the OIN to take action against Campanie, could not be forced to commence legal action against him.

The Court also severely limited the other OIN-backed claims against Campanie, limiting the scope of the action to claims accruing after April 11, 2010.

The Court noted that in deciding the preliminary motion, it was bound to “give the complaint a liberal construction, accept the allegations as true and provide plaintiffs with the benefit of every favorable inference” and stating that “the question of ‘[w]hether a plaintiff can ultimately establish its allegations is not part of the calculus in determining a motion to dismiss.”

The OIN has hired a prominent national law firm to sue DiNapoli and Campanie, bringing the suit some 12 years after New York State agreed to pay the private firms of the county attorneys of Oneida and Madison County in the defense of the OIN’s various legal actions, including its attempt to join 20,000 individual landowners as defendants seeking title to and ejectment from their lands. The arrangement, long public and disclosed for the entire period on Campanie’s County ethics disclosure forms, involved more than a decade of intensive legal work resulting in numerous and substantial legal victories, including the recent dismissal of the OIN’s 1974 Land Claim by the Supreme Court in October 2011.

That decision protected title to over 250,000 acres of public and privately held lands in Central New York and denied the OIN claim for hundreds of millions of dollars. The OIN continues in its attempts to take 13,000 acres into federal trust and out of taxable status, and continues to pursue federal action to have 307,000 acres determined to be a present Indian reservation.

Oneida Teen Charged With Weapon Possession

(Durhamville, NY – Jan. 26, 2012) Oneida-based state police charged an Oneida teen with Criminal Possession of a Weapon after he was stopped on Center Street in Durhamville Thursday evening.

At approximately 6 p.m. troopers were investigating a property damage motor vehicle accident on Center Street when a westbound 2008 Pontiac G6 drove around a marked patrol vehicle with emergency lights flashing and attempted to drive through the accident scene as a tow truck was removing a vehicle from the ditch and was blocking the roadway.

The Pontiac was stopped and its operator, a 16-year-old resident of Cottage Place, Oneida was found to be driving without either a valid driver’s license or learners permit.  While being interviewed, he was found to have a set of metal knuckles in his pants pocket.

He was taken into custody and transported to the Oneida barracks for processing and was charged with fourth-degree Criminal Possession of a Weapon and Unlicensed Operation of a Motor Vehicle and is scheduled to appear in the Town of Verona Court on Feb. 12.

The vehicle’s passenger, a 16-year-old resident of Summit Ave, Oneida advised troopers that the vehicle belonged to his mother and that he gave permission for the youth to get behind the wheel and that he was helping to teach him to drive.  The passenger was issued a traffic ticket for Permitting Unlicensed Operation returnable in the Town of Verona Court.
